2. What these terms cover
These terms apply to the Starlight Weather website and to the professional services offered on it — custom forecasts, severe-weather briefings, trend studies, consulting, produced broadcast segments, and live appearances ("Services"). The Cloudy app and the Come Rain or Shine podcast are provided through third-party platforms under their own terms.
3. How ordering works
Service requests are made by email. Prices shown on the site are starting prices; every request receives an individual quote with scope, timing, and total price. A contract is formed only when you accept the quote in writing (email is fine). Nothing on this website is a binding offer by itself.
4. Prices and payment
All prices are stated in the quote, including whether taxes apply. Payment terms (method and due date) are set out in the quote or invoice.
5. Delivery
Deliverables (forecasts, briefings, reports, video segments) are provided digitally by email or download link unless agreed otherwise. Delivery dates are stated in the quote. For time-critical work such as event forecasts, please request with enough lead time — this will be discussed when you order.
6. Right of withdrawal for EU consumers
If you order as a consumer in the EU, you normally have a 14-day right to withdraw from a distance contract. Please note: for services tied to a specific date (such as a forecast for your event), you may be asked to expressly agree that work begins before the withdrawal period ends. If the service is then fully performed, the right of withdrawal expires; if you withdraw after work has begun but before completion, you pay a proportionate amount for what has been done. Details are in the Refund Policy, and the withdrawal form is provided with your quote.
7. The nature of weather forecasts — important
Weather forecasts are professional scientific assessments of a chaotic system — they are made with care, qualifications, and the best available data, but no forecast can be guaranteed. Services are provided for planning support and information. They are not a substitute for official warnings: in situations involving danger to life or property, always follow the warnings and instructions of your national weather authority and civil protection services.
8. Liability
Liability is unlimited for intent, gross negligence, and injury to life, body, or health. Otherwise, liability is limited to foreseeable damage typical for this kind of contract, and mandatory statutory consumer rights remain unaffected. No liability is accepted for decisions made contrary to the qualifications and uncertainty ranges stated in a deliverable.
9. Intellectual property
Deliverables are created for you and may be used for the purpose agreed in the quote. The Starlight Weather name, logo, site content, and underlying methods remain the property of Starlight Weather. Broadcast segments and other media may only be redistributed as agreed.
10. Governing law and disputes
These terms are governed by the law of [your country], without prejudice to mandatory consumer protections of your country of residence. The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution before a consumer arbitration board.
